Called to Order:  7:35 PM under the M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5.  by Philip R. Lindquist, Chairman, in the Conservation Office on the second floor of the Town Hall.

Public Hearings

7:45 PM  Notice of Intent for construction of a single family house and septic system at Whitman Street, Assessor’s Map 101, Lot 2 for Habitat for Humanity represented by Land Planning, Inc., 1115 Main St., Hanson, MA  (DEP #175-420)

Craig Nicholson read the Public Hearing Notice.  The green cards were checked.  No abutters were present.  Jim Comeau of Habitat for Humanity presented revised plans which included an easement for access to Town Property adjacent to the property.  The plan has Board of Health approval.  Mr. Lindquist asked that disturbed areas be loamed and seeded.  Ms. Cassady indicated that double haybales are required around the well before any drilling takes place.  Phil Clemons commented that the corners of the Town Property should be marked.

Motion to close the hearing and approve the NOI pending an Order of Conditions:  Amy Gardner

Mr. Wynne presented photographs to the Board showing the revised, proposed location of an above-ground pool on a pre-existing clearing in his backyard.   No excavation is required for installation.  Also, he submitted a revised plan showing the location of where he would like to install a shed.   Mr. Nicholson suggested that the old haybale line be inspected.  Ms. Cassady will schedule an inspection.  Mr. Wynne was advised to apply for a Building Permit for the shed.

8:15 PM  Request for Determination for determining whether the boundaries of resource areas depicted on the plan are accurately delineated and whether any proposed work is subject to the jurisdiction of the Hanson Wetlands Protection By-Law at 662 West Washington St., Assessor’s Map 75, Lot 18-C for John & Charlene Lydon, represented by Vautrinot Land Surveying, Inc., P.O. Box 144, Plympton, MA 02367

Craig Nicholson read the Public Hearing Notice and the green cards were checked.   Al Vautrinot presented plans indicating the wetland line.  He proposed that the brook is intermittent and therefore not subject to the River’s Act.  Ms. Cassady made a site visit and her recommendation is that the wetland line is accurate and the brook shown is probably a drainage ditch.   A new filing will be required for any future digging and/or construction.

Motion to accept the wetland line as shown on the plan and issue a Positive 2a Determination:  Amy Gardner

8:30 PM  Notice of Intent for construction of a single family house and septic system at Holly Ridge Drive, Assessor’s Map 111, Lot 115 for Keene Contractor’s P.O. Box 185, Hanson, MA represented by Webby Engineering, 180 County Rd., Plympton, MA  (DEP #175-419)

Mr. Nicholson read the Public Hearing Notice and the green cards were checked.  Mr. Keene was not present.    Joseph Webby presented an old plan for the project that was dated 2001.  Ms. Cassady had written Mr. Keene requesting a wetland report and By-Law fees.  Mr. Lindquist suggested that since more information and an updated plan were needed, the hearing should be continued.

8:45 PM  Request for Determination for repair of a septic system with grading and filling within the 100 foot buffer zone of a bordering vegetated wetland at 67 Meryl Street, Assessor’s Map 80, Lot 145 for Kenneth Caron represented by Alan Dias, P.O. Box 314, Monponsett, MA  

The Public Hearing Notice was read by Craig Nicholson and the green cards were checked.  Mr. Dias presented plans for a septic upgrade for an existing house.  Mr. Lindquist asked that the system would be loamed and seeded after construction.

Orders of Conditions/Determinations of Applicability/Certificates of Compliance

Determination of Applicability for installation of a septic tank, pump chamber and construction of an addition to an existing dwelling at 889 Winter St., Assessor’s Map 114, Lot 8 for Denis Donaghey with special orders:   1. To install dbl.staked haybales as shown on approved plans prior to the start of construction.  2. There shall be an inspection scheduled with the Conservation Commission and/or it’s agent to ensure that the haybales are installed correctly. 3.  Once the septic system installation is completed, the disturbed soil shall be seeded with a grass mix to stabilize the area prior to the removal of the haybales. - SIGNED
Partial Certificate of Compliance for 197 Liberty St., Assessor’s Map 91, Lot 14-3, owner New England Water Purification c/o Donald Norris 636 Broadway, Hanover, MA  (DEP #175-322) - SIGNED

Order of Condtions for construction of an addition to replace an existing deck at 32 Country Lane, Assessor’s Map 88, Lot 8-20B with George and Karen Duclos   (DEP #175-414) with special orders:  1.  A variance request was approved at the Jan. 13, 2004 meeting with the understanding that the addition and deck will not extend any further out toward the wetland from the back of the existing main house by more than 15’.  This variance was approved for the 15’ addition out from the existing main house because this is what was approved in the original filing for the house in 1986.  2.  Stakes for the loc. of the erosion controls (haybales & silt fence) shall be installed first as shown on the appr. plans at the 25’ buffer mark.  Then, a site visit shall be scheduled with the ConComOffice.  Call for appointment (781-294-4119, Ext. 118).  3.  Once the loc. of the erosion controls is finalized, then the haybales and silt fence can be installed.  The haybales shall each have two stakes cut flush with the top of the bale and the silt fence shall be

installed in front of the bale and either anchored down by the bale trenched into the ground or anchored by stones or mulch.  4.  A revised plan showing the proposed 10’ x 10’ deck on the northern back corner of the existing house shall be submitted prior to the issuance of these orders.  5.  Erosion controls shall remain in place until all the work is complete and the yard has been stabilized by grass or other vegetation. - SIGNED

Order of Conditions for construction of a single family dwelling, septic and driveway at 411 Brook Street, Assessor’s Map 96, Lot 13B with owner Mary Powell represented by Land Planning, Inc., 1115 Main St., Hanson.  (DEP #175-418) with special orders:  1.  The erosion controls (haybales & silt fence) shall be installed as shown on appr. plans prior to the start of any construction.  2.  The loc. of the house shall be staked out also and a site visit shall be scheduled with the Conservation Office (781-294-4119, Ext. 118).  3.  The haybales shall be inst. with each bale having 2 stakes cut flush with the top of the bale.  The silt fence shall be inst. in front of the bales and anchored down by bales, stones or have the fence trenched into the ground.  4.  The erosion controls shall remain installed until all of the work is completed and the ground has stabilized with vegetation.  A site inspection shall be scheduled with the Conservation Office prior to the removal of the erosion controls. - SIGNED

Orders of Conditions for construction of an addition off a single family house, driveway, and site grading at 131 Whitman St., Assessor’s Map 106, Lot 1-6 with owner James Arena represented by Sean Hegarty of Land Planning, Inc., 1115 Main St., Hanson.  (DEP #175-417) with special orders:  1. The variance request was approved at the Jan.13, 2004 meeting due to the need for driveway access that conforms with the sequence of house numbers and one that emergency vehicles will be able to locate.  2.  The location for the erosion controls (haybales) shall be staked off prior to inst. so that a site visit can be scheduled with the Conservation Office to approve the final location - 781-294-4119, Ext. 118.  3.After the location of the erosion controls is approved, they shall be installed and another site visit shall be scheduled with the ConCom.  4.  The erosion controls shall be inst. as shown on the approved plans.  The stakes shall be cut flush with the top of the bales.  5.  Once the erosion control approval has been given by the Conservation Office, only then can the work on the driveway begin.  6.  The driveway was approved to be paved for it’s entire length and the configuration of the driveway as shown on approved plans was also approved.  7.  No other work shall occur within the 50’ no disturb area other than that which was approved through this Order of Conditions.  8.  The proposed garage and mudroom addition was also approved by the ConCom on Jan.13, 2004.  9.The haybales shall remain intact till all of the work is completed and the area between the driveway and the haybales is stabilized with vegetation.  10.  The width of the driveway shall not exceed 10’ except in the areas as shown on the approved plans. - SIGNED

Order of Conditions for construction of an addition and two decks to an existing single family home at 91 Forest Trail, Assessor’s Map 101, Lot 5D-4   with owner Bruce Boyd represented by John Delano, 220 Hudson St., Halifax, MA  (DEP #175-413) with special orders:  1. The variance request was approved at the Jan. 13, 2004 mtg.. The variance was given per the Section in the Town Wetland Protection By-Law with Rules and Regulations, Regulation section on buffer zone setbacks (8.01)(3)(C).  Also, a living fence was proposed and no wetland resource area alteration is proposed.  2.  Prior to the start of any construction, the location for erosion controls (haybales and silt fence) shall be staked off prior to installation so that a site visit can be scheduled with the Conservation Office.  Please call 781-294-4119, Ext. 118 for an appointment.  3.After the location of the erosion controls is approved, they shall be installed and another site visit shall be scheduled with the Conservation Commission.  Once the installation of the erosion controls is approved, only then can construction begin. 4.The erosion controls shall be installed as shown on the approved plans.  The haybales shall be dbl.staked with the stakes cut flush with the top of the bales.  The silt fence shall be placed in front of the haybales and trenched in as shown on approved detail -
sheet dated Dec. 23, 2003, sheet 2 of 2.  5.  The proposed living fence as shown and described on approved plans shall be implemented.  The planting strip is to be constructed by removing the surface sod and tilling along the proposed 3’ wide planting strip.  The edge closest to the wetland side will be planted with an alternating row of Silky dogwood, Red oster dogwood and High bush blueberry shrubs spaced 5’ on center.  Plants shall be 18” to 24” in size.  The remaining portion of the planting strip will be planted with a conservation seed mix such as N.E.Conservation/Wildlife mix with the application rate being 1 lb. Per 1,743 sq.ft.  6.  There shall be two infiltration trenches for the roof drain run off as shown on approved plans.  7.  Only the driveway, garage, back deck, front porch and two infiltration trenches are approved by the ConCom in the dimensions shown on approved plans.  No other work is approved.  8.  Any changes to the approved plans will require an amendment to this Order of Conditions.  9.  The erosion controls shall remain in place until all of the construction is completed.  Once construction is completed, another site visit shall be scheduled with the Conservation Office.  10.  Once the planting strip is ready to be installed, the erosion controls on the back side of the house shall be moved, or new ones shall be installed behind where the planting strip is to be located and a site visit shall be scheduled with the Conservation Office. - SIGNED
Discussions

In regards to the Superseding Order of Conditions from DEP for Don Ellis/Union St. (DEP#175-369), Ms. Cassady said that Mr. Ellis cannot go forward with the project unless he has a Court Order.

Ms. Nehiley will check with Merry Scozzari to see if we have to resubmit an Article for the Transfer of Tax Title Land before the deadline of February 24, 2004.

Alan Dias discussed with the Board a Consent Order that will be issued from the Department of Environmental Protection for the cleanup of the Dunstan Property, 181 Hill St., Assessor’s Map 70, Lots 2B2, 29, & 29F.   The DEP got involved through the complaints of neighbors.  Mr. Dias asked if the Board would like him to file a Notice of Intent with this office or can he be allowed to work under DEP guidelines.  Ms. Cassady had had a conversation with Ed Burke, Enforcement Officer with the DEP.  She recommends that haybales and a silt fence be placed at the bottom of the slope and anchored in.  Phil suggested the Conservation Commission draft a Memorandum of Understanding and that Mr. Dias proceed with the cleanup under DEP guidelines.

Open Space

Phil Clemons, Associate Member, addressed the Board regarding the progress of Open Space issues:  Camp Kiwanee is slated for a restoration project in April.  They would like to restore the dock area for the use of boating.  Also, the existing cart path and trails from Camp Kiwanee to  Maquan Street will be marked with Bay Circuit signs that would create an enjoyable loop which would lend itself to hiking or cross country skiing.

Mr. Clemons, at Mr. Lindquist’s request, said that he was agreeable to attending Town Meeting to support the article for the Transfer of Tax Title land off West Washington Street to gain access to the Gaffey Conservation property.  

Phil would like the Board to respond to a letter from a person that wants to donate land on Winter Street to Conservation.  It is his contention that we should not let opportunities like this pass as it is a worthwhile Conservation project.   Ms. Cassady will draft a letter.
